1. This online store, operating under the domain "jjaskowiakart.com" (Store), allows you to purchase goods via the Internet, under the terms and conditions specified in these Regulations.
2. The Store is run by Aleksandra Jaśkowiak, running a business under the name Aleksandra Jaśkowiak (business address: ul. Zakole 16/44, 62-10 Konin), NIP number: 6653024983 (hereinafter referred to as the Seller).
3. These Regulations are addressed to all persons who purchase or intend to purchase goods through the Store (hereinafter referred to as the Buyer). It specifies in particular the rules for registering and using the store account, the rules for making electronic reservations of products available in its offer, placing orders and the rules for concluding contracts for the sale of goods.
4. Each Buyer can gain access to the Regulations at any time by "clicking" the "Regulations" link located on the store's website. The Regulations will also be available in the form of a PDF file, available for saving and processing by the Buyer using their own storage medium (computer, telephone, portable memory, etc.).
5. The condition for starting to use the store is to read and accept these Regulations.
6. The Store does not direct its activities outside the territory of the Republic of Poland, but only allows Buyers to indicate the place of delivery in a European Union Member State, taking into account the principles set out in point V of the Regulations.
1. The Buyer is obliged to refrain from using the Store in an unlawful manner or infringing the rights of other Buyers. In particular, the Buyer is obliged to:
a) Not to provide or transmit content prohibited by law;
b) Use the Store in a way that does not disrupt its operation;
c) Do not send or place unsolicited commercial information or harmful software in the Store.
2. The Buyer can use the Store without creating his own account.
3. Technical conditions enabling the use of the Store's websites are as follows:
a) Access to the Internet,
b) Using a web browser that allows editing hypertext documents (Internet Explorer, Opera, FireFox or similar),
c) A program that allows reading "pdf" files,
d) Having an e-mail account.
4. The information provided by the Buyer when placing the order should be true, current and accurate.
1. Information about products in the Store, in particular descriptions, presentations and given prices, cannot be construed as an offer within the meaning of the Civil Code, but only as an invitation to submit an offer to conclude a contract within the meaning of Art. 71 CC
2. The Buyer takes the initiative to conclude a sales contract via the Store by placing an Order (offer). An order can be placed in one of the following ways:
a) via the form available on the website (Online Order),
b) by telephone (call cost according to the rates of the Buyer's operator),
c) via electronic mail (e-mail).
3. Online orders can be placed on all days of the week, including Sundays and holidays, 24 hours a day. Orders placed by phone and e-mail are accepted on working days from 9:00 a.m. to 5:00 p.m. Orders placed on non-working days will be accepted for processing on the first business day following the day on which the order was placed.
4. The Buyer is obliged to:
a) In the case of online orders - to select the ordered products from the Store's offer, indicate their quantity and provide all data marked as "mandatory" in the Order form.
b) In the case of telephone or e-mail orders - to provide at least the following data:
• precise marking of the ordered items and their quantity,
• indication of additional parameters of the ordered items, if the need to provide them results from the content of the descriptions posted on the Store's website (e.g. size, color, etc.),
• data for order processing (street, building/apartment number, postal code, city),
• selecting the request to receive a VAT invoice and providing the data necessary to issue it.
5. The order cannot be withdrawn or changed by the Buyer:
a) in the case of online Orders - from the moment of sending it by clicking the "Confirm" button. Order with the obligation to pay" ;
b) in the case of telephone orders - from the moment the Store employee informs about the acceptance of the order;
c) in the case of e-mail Orders - from the moment of receiving an e-mail confirming acceptance of the Order for execution;
6. The Store sends confirmation of acceptance or refusal to accept the Order to the e-mail address provided by the Buyer. When the Buyer receives confirmation of acceptance of the Order by the Seller, a sales contract for the goods ordered by the Buyer is concluded.
1. Product prices in the store are given in Polish zloty and include all its components, including VAT, customs duties and taxes.
2. The Buyer is bound by the prices applicable at the time of placing the Order, even if the prices given on the Store's website change during its execution.
3. Shipping costs depend on the delivery method chosen by the Buyer and are added to the total of the Order.
4. The Buyer pays for the ordered products by bank transfer to the Seller's account or online transfer.
5. The data necessary to make the transfer are made available to the Buyer after placing the order. If you choose the payment method in the form of prepayment, failure to receive payment within 3 days of placing the Order will result in its cancellation. In such a situation, it is possible to place the Order again and select a different form of payment. The execution of an Order paid for in advance begins after receiving the payment for the goods.
6. If you choose the option of delivery of goods outside the territory of the Republic of Poland, payment of the price of the goods is possible only in the form of electronic payment.
1. Products are delivered to the address indicated in the Order via INPOST courier or POCZTA POLSKA (GLOBAL EXPRESS). The store sells only online, the Buyer is not entitled to collect the ordered goods in person.
2. If the address details provided by the Buyer for the place of delivery turn out to be so inaccurate that the execution of the Order is impossible, the Seller will attempt to contact the Buyer in order to clarify or correct the necessary data.
3. Product delivery fees are provided during the ordering process and depend on the selected delivery method.
4. The total and maximum deadline for completing the Order should not exceed 30 business days from the date the full amount of the Order is credited to the Seller's bank account.
5. Customers are entitled to indicate the place of delivery of goods also outside the territory of the Republic of Poland:
a) The order completion date depends on the place of delivery of the goods,
b) The cost of shipping goods in domestic and foreign circulation is given in the footer of the website in the "Payment and Shipping" tab,
c) The costs of returning the goods after withdrawal from the sales contract are covered by the Buyer (except in the case of defective goods).
7. With the delivery of the goods, the Buyer will receive written confirmation of the conclusion of the contract, including in particular information about the ordered products and their quantity, order value, selected type of delivery and payment, as well as other information provided for by applicable law.
1. Without prejudice to the right to withdraw from the contract provided for in the relevant legal provisions, the Buyer may cancel the Order before its confirmation by the Store. In such a case, the Buyer should contact the Store as soon as possible, in particular by telephone.
2. The Buyer has the right to withdraw from a distance contract in accordance with applicable law:
a) in the case of contracts concluded until December 24, 2014 inclusive - in accordance with Art. 7 of the Act of March 2, 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product (consolidated text: Journal of Laws of 2012, item 1225, as amended),
b) in the case of contracts concluded from December 25, 2014 inclusive - in accordance with Art. 27 et seq. of the Act of May 30, 2014 on consumer rights, except that the statutory deadline for withdrawal from the contract is extended to 30 days; The Seller provides a model withdrawal form consistent with the Act and the information required by the Act, available at: ...
3. In the event of withdrawal from the contract referred to above, shipping costs are, subject to paragraph 4 below, refunded on the following terms:
a) in the case of contracts concluded up to and including December 24, 2014 - the cost of shipping the goods "to the Buyer" (paid together with the Order price) is refunded, while the Buyer is obliged to bear the cost of sending the goods back "to the Seller".
1. The products offered in the store are brand new, refurbished and original. The Seller is obliged to deliver the goods to the Buyer without defects.
2. The Seller is liable to the Buyer for non-compliance of the ordered goods with the contract under the terms provided for by applicable law.
3. If the Buyer finds that the delivered goods are inconsistent with the contract (defective), a complaint should be submitted. It is recommended to submit a complaint by post, by returning the goods along with a written description of the defect or a complaint form downloaded from the Store's website. Shipment may be made by registered letter, parcel or other form of shipment to the following address: Jacek Jaśkowiak, ul. Rumin 2a, 62-571 Stare Miasto - with the note: "Complaint". The Buyer may also contact the Store regarding complaints in any other way indicated on the Store's website (e-mail, telephone, online forms).
4. The Buyer will receive information on how the complaint will be considered within 14 days from the day following the receipt of the shipment containing the complained goods by the Store. If the complaint is accepted, the Seller will send the Buyer a full-value product (repaired or new), and if this proves impossible (e.g. out of stock), it will refund the full amount of the paid price of the goods along with all other costs. The above provisions do not limit the Buyer's rights under applicable law.
5. If the complaint is not accepted, the goods will be sent back along with an opinion on the groundlessness of the complaint.
6. The Seller does not provide a separate, own warranty for the products sold within the meaning of Art. 577 et seq. CC. If a warranty has been granted for a given product by the manufacturer (importer), this fact will be noted in the product description available on the Store's website. In such a case, the Buyer's warranty rights will be determined by the provisions of the warranty card or other statements of the manufacturer (importer). Even in such a case, the entity liable under the warranty will be the manufacturer (importer) or other entity that granted the warranty, and not the Seller.
1. The administrator of the Buyers' personal data is Aleksandra Jaśkowiak, running a business under the name Aleksandra Jaśkowiak (business address: ul. Zakole 16/44, 62-10 Konin, NIP: 6653024983 (Seller).
2. The Seller declares that the Buyers' personal data are processed in accordance with the Personal Data Protection Act of August 29, 1997 (Journal of Laws 1997, No. 133, item 883, as amended). The Seller ensures that the Buyers exercise the rights arising from the above Act and other generally applicable regulations
3. All personal data provided by Buyers are processed solely for the purpose of executing concluded sales contracts.
4. Buyers' personal data are not made available to third parties, with the exception of subcontractors, employees or associates of the Seller providing services or performing work in connection with the execution of Orders, and entities providing debt collection services. Personal data will be made available to the above entities only to ensure the proper execution of Orders.
1. The sales contract is concluded in Polish, with content consistent with these Regulations. The law applicable to the contract is Polish law.
2. The Seller reserves the right to change these Regulations, which will be informed each time through announcements placed on the Store's website. Such changes will not violate the rights of persons who concluded sales contracts for goods offered by the Store before making the above-mentioned changes.
